Terms of Service

The terms governing your use of AfriQ services — across internet, voice, SMS, web, solar and infrastructure.

1. Agreement

These Terms govern the services provided by AfriQ Network Solutions Limited (AS328475). By ordering or using our services you agree to these Terms, together with any service-specific order forms and our Acceptable Use Policy and Privacy Policy.

2. Our services

These Terms apply to all AfriQ services, including: Internet (FTTH/FTTB, wireless, IP transit, bulk IP), Voice & SIP, Bulk SMS, Web Hosting, Domains & SSL, Solar Energy, and Infrastructure Sharing (dark fibre, colocation, tower space).

3. Orders & provisioning

Service begins once your order is accepted and, where applicable, a coverage check or site survey is completed. Some services require installation, equipment or third-party approvals.

4. Fees & payment

Fees are as stated on your order or invoice. We accept M-Pesa, Equitel, Airtel Money, PayPal and card. Services may be suspended for non-payment. Prepaid products (e.g. SIP minutes, SMS) are used against your balance.

5. Service levels

Business and wholesale services may include a Service Level Agreement (SLA) covering availability and support response. Any service credits are as defined in the applicable SLA.

6. Acceptable use

You agree to use our services lawfully and in line with our Acceptable Use Policy. We may suspend or terminate services used for abuse, illegal activity, or that threaten network integrity or security.

7. Customer responsibilities

You are responsible for the security of your account credentials, equipment at your premises, content you host or transmit, and compliance with applicable laws.

8. Suspension & termination

Either party may terminate as set out in your order. We may suspend services for non-payment, abuse, or legal/regulatory reasons, giving notice where practicable.

9. Liability

To the extent permitted by law, our liability is limited as set out in your order/SLA. We are not liable for indirect or consequential loss.

10. Governing law

These Terms are governed by the laws of Kenya, and are subject to applicable Communications Authority of Kenya licensing and regulation.

11. Changes

We may update these Terms from time to time; the current version is always published here.
